The profession of legal advisor is a profession of public trust, operating under the Law on Legal Advisors of July 6, 1982. The practice of the profession of legal counsel consists in providing legal assistance. Providing legal assistance is, in particular: giving legal advice and consultations, drawing up legal opinions, preparing drafts of legal acts and appearing before offices and courts as an attorney or defense counsel, including before the Supreme Court, the Constitutional Court, the Supreme Administrative Court, the Court of Justice of the European Union and the European Court of Human Rights. An important fact is that there are no restrictions on the entities to which a legal counselor may provide legal assistance. In the Polish legal order, the profession of legal advisor, in type, is most similar to the profession of advocate. The only difference between the two professions is that legal advisors - unlike attorneys - can also practice their profession in an employment relationship. However, if they practice their profession in an employment relationship, they cannot then act as defense counsel in cases of criminal and fiscal offenses, except in the case of the employment relationship of scientific and research and teaching staff.
